Terms of Service

1. Agreement

By creating an account, logging in or otherwise using ApnaTrack (the website, web app, admin panel, API and mobile app), you agree to these terms. If you are using ApnaTrack for a company, school or other organisation, you confirm that you are allowed to accept these terms on its behalf.

2. The service

ApnaTrack lets you see the location and status of vehicles fitted with compatible GPS tracking devices, view history, trips, stoppages and summaries, receive alerts, monitor fuel (with a fuel sensor), draw geofences and download reports. Features available to you depend on your plan and on the device fitted in each vehicle.

3. Your account

• Keep your login details confidential and make sure the users you add do the same. You are responsible for activity under your account.
• Give us correct contact information so we can reach you about your account and alerts.
• Tell us promptly if you believe your account has been misused.

4. Acceptable use

• Track only vehicles that you own or are authorised to track, and inform drivers, staff, students or passengers where the law requires it.
• Do not use ApnaTrack to stalk, harass or unlawfully monitor any person.
• Do not attempt to break, overload, reverse-engineer or gain unauthorised access to the service or the API, and keep API keys secret.

We may suspend accounts that break these rules.

5. Devices, accuracy and alerts

• Tracking depends on the GPS device, its installation, power supply, satellite signal and mobile network coverage. Positions, speeds, fuel values and alerts may sometimes be delayed, missing or inaccurate.
• Fuel readings require a correctly fitted and calibrated fuel sensor.
• ApnaTrack is not an emergency service. SOS/panic alerts are a helpful notification only. In an emergency, always call 112 or the relevant local emergency number.

6. AIS-140 (VLTD) devices

For AIS-140 devices, ApnaTrack is configured as a secondary server. The device's reporting to the government Vehicle Location Tracking System (VLTS) continues as before and is not changed by ApnaTrack. You remain responsible for your device's registration, approvals and any regulatory compliance.

7. Plans and payment

• Prices are shared with you as a quote and are charged as per your invoice or agreed plan.
• If payments are overdue, we may limit or suspend access after giving notice.
• Device hardware, SIM/data charges and installation are separate unless your quote says otherwise.

8. Resellers and partners

Partners who use ApnaTrack to serve their own customers (including under their own brand) are responsible for their customers' accounts, support and billing, and must make sure their customers follow these terms and the privacy policy. ApnaTrack may contact a partner's customers directly where necessary for security, legal or service reasons.

9. Your data

You own the data about your vehicles. We process it to provide the service as described in our Privacy Policy, including data retention (raw positions for about 6 months, then daily summaries) and daily backups. We never sell your data.

10. Availability and changes

We work to keep ApnaTrack available around the clock, but there may be interruptions for maintenance, upgrades or reasons beyond our control. We may improve, change or retire features over time; if a change materially reduces what you have paid for, we will tell you in advance.

11. Limitation of liability

To the extent allowed by law, APNA INFOTECH is not liable for indirect or consequential losses (such as loss of business, theft of vehicles or fuel, or fines) arising from the use of, or inability to use, ApnaTrack. Our total liability for any claim is limited to the amount you paid us for the service in the three months before the claim.

12. Ending the service

You may stop using ApnaTrack at any time and ask us to delete your account by contacting us. We may end or suspend the service for breach of these terms or non-payment. After closure, your data is deleted as described in the Privacy Policy.

13. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the courts at Bikaner, Rajasthan.
